Terms & Conditions
1. Basic Provisions
These Terms and Conditions govern the contractual relationship between Martina Kunstovná, Company ID: 03813169 (hereinafter "the Provider"), and the client or buyer (hereinafter "the Customer") in the provision of interior design services and related sales.
2. Offered Services and Products
The Provider offers in particular:
- Interior design proposals and consulting services.
- 3D visualizations and technical documentation.
- Original furniture, textiles and merch (e.g., posters, accessories).
3. Pricing and Payment
- Prices are determined individually according to the scope of the project or according to the current offer on the website.
- The Provider is not a VAT payer. Prices are final.
- Payment is made by bank transfer or via the payment gateway (Stripe).
- Payment terms are stated on the invoice or in the order confirmation.
- Deposits: A deposit may be required for design services. By commencing work, the Provider is entitled to a proportionate part of the price corresponding to the work already performed.
4. Orders and Delivery
- Orders are accepted via email, contact form or the online shop.
- Delivery times are negotiated individually; for goods, they are listed with the product.
- Delays: Delivery deadlines are reasonably extended in case of the Customer's delay in providing materials or cooperation.
5. Copyright and Licensing
- Work protection: All website content and outputs (designs, visualizations, posters) are protected by copyright law.
- License: The Customer receives a non-exclusive license for personal, non-commercial use. Any commercial distribution, reproduction or modification is only possible on the basis of a separate license agreement.
- Portfolio: The Provider reserves the right to use completed projects and their documentation for their own presentation and marketing, unless otherwise agreed.
6. Creative Process and AI
- Use of AI: Visuals may be co-created using generative AI as a tool, under the creative direction of the Grain of Design brand.
- Aesthetics: Design service is a creative process. The Provider is responsible for professional execution, not for the Customer's subjective aesthetic evaluation of the result.
- The Customer acknowledges that the design service includes interpretation of the brief and creative decisions by the Provider.
7. Withdrawal from Contract and Digital Products
- Custom-made goods: For products made to order (personalized merch, interior designs), withdrawal from the contract within 14 days is not possible.
- Digital products: For downloadable files (graphics, templates), the right of withdrawal expires upon commencement of performance (sending the link/download) with the Customer's consent.
- Standard goods: For standard goods, the right of withdrawal within 14 days is preserved.
- The Customer expressly agrees to the commencement of performance before the expiry of the withdrawal period prior to completing the order.
8. Complaints and Dispute Resolution
- Complaints are handled individually with emphasis on agreement. The resolution period is 30 days.
- Out-of-court resolution: The Customer has the right to out-of-court resolution of a consumer dispute at the Czech Trade Inspection Authority (www.coi.cz).
9. Liability
The Provider is not liable for delays caused by the Customer (late materials). The Provider guarantees professional quality, not the Customer's subjective taste.
The Provider is not responsible for decisions made by the Customer based on proposals (e.g., purchase of equipment, implementation).

The current version of the terms is always available on the website. The Provider reserves the right to update them.
